These Terms of Sale govern the sales of cosmetic products and leather goods made by SIWARA PARIS on the siwaraparis.fr website. In accordance with current French and European legislation, including the French Consumer Code and European Directive 2011/83/EU on consumer rights, these Terms of Sale apply to all orders placed on our online store.

ARTICLE 2 – PURPOSE AND SCOPE

These Terms of Sale define the rights and obligations of the parties in the context of online sales of products offered by SIWARA PARIS.

These Terms of Sale apply to the exclusion of all other conditions, particularly those applicable to in-store sales or other distribution channels.

SIWARA PARIS reserves the right to modify these Terms of Sale at any time. The applicable Terms of Sale are those in force on the date of the order.

ARTICLE 3 – PRODUCTS

SIWARA PARIS offers the following products for sale:

  • Luxury cosmetic products (skincare, perfumes, makeup, etc.)
  • Leather goods (bags, wallets, accessories, etc.)

Products are described and presented as accurately as possible. However, photographs and descriptions are not contractual. Product colors may differ slightly from reality due to your screen display settings.

All our products comply with current French and European legislation, particularly regarding the safety of cosmetic products (Regulation EC No. 1223/2009).

ARTICLE 4 – PRODUCT LIABILITY

4.1 Cosmetic and fragrance products

Cosmetic and fragrance products offered for sale are subject to Regulation (EC) No. 1223/2009 on cosmetic products.

Responsible Person:

Cosmetic products sold on siwaraparis.fr are supplied by specialized partners and certified French laboratories.

In accordance with Regulation (EC) No. 1223/2009, the Responsible Person for placing each cosmetic product on the market is the partner supplier (laboratory or brand) who ensures:
- Regulatory compliance and safety of formulations
- Mandatory notifications to competent authorities (CPNP for the European Union and/or France, UKCP for the United Kingdom depending on products)
- Responsibility as Responsible Person within the meaning of the regulation

Role of SIWARA PARIS:

SIWARA PARIS acts as a distributor of these cosmetic products. Regulatory responsibility as Responsible Person is assumed by each partner supplier.

The contact details of the Responsible Person are indicated on the labeling of each product in accordance with current regulations.

4.2 Leather goods and accessories

For leather goods and accessories, SIWARA PARIS is the Responsible Person as the party placing the products on the market.

These products are manufactured to our specifications by selected industrial partners. SIWARA PARIS assumes responsibility for regulatory compliance, safety and quality of these products.

4.3 Claims

In case of a claim relating to the safety or compliance of a product:

- For cosmetic products: contact contact@siwaraparis.fr - SIWARA PARIS will forward your claim to the relevant Responsible Person who will handle the follow-up
- For other products: contact contact@siwaraparis.fr

SIWARA PARIS is committed to marketing only products that comply with current European regulations and to working with partners who respect these same requirements.

ARTICLE 5 – PRICES

Our product prices are indicated in euros (€).

In application of Article 293 B of the French General Tax Code, SIWARA PARIS benefits from the VAT exemption scheme. The displayed prices therefore do not include VAT.

The displayed prices do not include delivery costs, which are indicated separately before order validation.

SIWARA PARIS reserves the right to modify its prices at any time. However, products will be invoiced based on the rates in force at the time of order validation, subject to availability.

For deliveries outside the European Union, customs duties, import taxes or other local fees may apply and are the exclusive responsibility of the customer.

ARTICLE 6 – ORDER

6.1 Order process

To place an order, the customer must:

  1. Select products and add them to the cart
  2. Check the cart contents and delivery costs
  3. Create an account or order as a guest
  4. Enter delivery and billing information
  5. Choose the delivery method
  6. Choose the payment method
  7. Accept these Terms of Sale by checking the box provided for this purpose
  8. Confirm and validate the order by clicking the payment button

6.2 Order validation

Order validation implies acceptance of these Terms of Sale and constitutes proof of the sales contract. The customer acknowledges having read and accepted these Terms of Sale before placing the order.

Once the order is validated, the customer receives a confirmation email summarizing:

  • The order number
  • The products ordered
  • The total amount
  • The delivery address
  • The chosen delivery method

This confirmation serves as acknowledgment of receipt of the order and proof of the sales contract.

6.3 Product availability

Our product offers are valid subject to available stock. In case of product unavailability after the order has been placed, the customer will be informed by email as soon as possible. The customer may then choose to:

  • Cancel the order and obtain a refund of the amounts paid within 14 days
  • Wait for product availability
  • Replace the product with an equivalent item

ARTICLE 7 – PAYMENT

7.1 Accepted payment methods

SIWARA PARIS accepts the following payment methods:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Apple Pay
  • Google Pay
  • Shop Pay
  • Klarna (installment payment)

For installment payments via Klarna, eligibility conditions and payment terms are defined by Klarna. The customer is invited to consult Klarna's terms and conditions during the payment process.

7.2 Payment security

All payments are secure. Banking information is encrypted and transmitted securely via SSL protocol. SIWARA PARIS does not store any banking data.

Payment is due immediately upon ordering. The order will only be processed after payment confirmation.

ARTICLE 8 – DELIVERY

8.1 Delivery Zones

SIWARA PARIS ships worldwide, with restrictions depending on product types:

For cosmetics and perfumes:

• Metropolitan France • European Union (27 member countries) • United Kingdom (only for cosmetic products for which we are an authorized distributor)

For leather goods:

• Metropolitan France and European Union • United Kingdom • North America (United States, Canada) • Middle East (United Arab Emirates, Qatar, Saudi Arabia, Kuwait, Bahrain, Oman) • Africa (Morocco, Tunisia, Algeria, Egypt, Senegal, Ivory Coast, Cameroon) • Asia-Pacific (Singapore, Hong Kong, Japan, South Korea, Australia, New Zealand) • Over 150 countries worldwide

Cosmetics and perfumes are subject to specific regulations in each country. Selected cosmetic products may be shipped to the United Kingdom subject to regulatory authorizations.

Available delivery zones for your order are indicated during the checkout process based on the selected products.

8.2 Delivery Times

Delivery times are indicative and run from the shipping date of the order:

• Metropolitan France: 3 to 5 business days (standard delivery) • European Union: 5 to 10 business days • United Kingdom: 10 to 15 business days • International (North America, Middle East, Africa, Asia-Pacific): 10 to 20 business days

These times may vary during peak periods, due to customs procedures, or in exceptional circumstances.

8.3 Shipping Costs

Shipping costs are calculated based on weight, destination, and chosen delivery method. They are indicated before order validation.

Free shipping offers (standard delivery only):

• Free shipping in metropolitan France for orders over €50 • Free international shipping for orders over €150

Express shipping costs remain the customer's responsibility regardless of order amount.

8.4 Customs and Taxes (International Deliveries)

For deliveries to the United Kingdom: Displayed prices exclude UK VAT. UK VAT (20%) and any customs fees are the customer's responsibility and will be collected by the carrier upon delivery.

For other deliveries outside the European Union:Customs fees and import taxes may apply. These fees are the customer's sole responsibility and are not included in the order price. They are calculated by local customs authorities and payable upon receipt of the package.

SIWARA PARIS is not responsible for customs fees, delays caused by customs procedures, or packages refused or returned due to unpaid customs fees.

8.5 Delivery Terms

Delivery is made to the address provided by the customer when ordering. It is the customer's responsibility to verify the accuracy of the delivery address. SIWARA PARIS cannot be held responsible for errors in the provided address.

In case of absence during delivery, a delivery notice will be left. The package will then be available at the nearest relay point or post office.

8.6 Receipt and Verification

The customer must verify the condition of the package in the presence of the delivery person. In case of damaged package, the customer must:

• Refuse the package or make written reservations on the delivery note • Take photos of the damaged package • Contact SIWARA PARIS within 48 hours at contact@siwaraparis.fr

Transfer of ownership and risks occurs upon delivery of the product to the customer.

ARTICLE 9 – RIGHT OF WITHDRAWAL AND RETURNS (30 DAYS)

In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has a legal period of 14 calendar days from receipt of the products to exercise their right of withdrawal without having to justify reasons or pay penalties.

SIWARA PARIS offers an extended return period of 30 calendar days from receipt of the products.

9.1 How to exercise the right of withdrawal

To exercise the right of withdrawal, the customer has two options:

Option 1: Self-service return (recommended)

  • Log in to your customer account on our website
  • Access your orders
  • Click on "Request a return" on the relevant order
  • Select the product(s) to return and the reason
  • You will automatically receive return instructions by email

Option 2: By email

  • Contact us at contact@siwaraparis.fr
  • Indicate your order number and the product(s) to return
  • We will send you instructions within 48 hours

The customer may also use the standard withdrawal form available on our website or any other unambiguous statement expressing their wish to withdraw.

9.2 Return conditions

Products must be returned:

  • In their original condition
  • Unused
  • For cosmetic products: security seal intact and unopened (for hygiene and health protection reasons)
  • In their original packaging with all labels
  • Accompanied by the invoice

Examples of returnable products:

  • Perfume with intact unopened seal
  • Serum with intact security seal
  • Unworn handbag with labels

Examples of NON-returnable products:

  • Opened perfume or with broken seal
  • Started cream or serum
  • Cosmetic product with opened packaging
  • Worn handbag or without labels

9.3 Exceptions to the right of withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:

  • Unsealed or opened cosmetic products (for hygiene and health protection reasons)
  • Personalized or custom-made leather goods

9.4 Return costs

Return costs are the customer's responsibility, except in the following cases:

  • Defective or damaged product upon receipt
  • Non-compliant product or error on our part

In these cases, SIWARA PARIS covers the return costs.

9.5 International returns

For customers located outside France:

  • International return costs are the customer's responsibility
  • The customer is responsible for customs formalities for the return
  • Any customs fees for the return are not refunded
  • We recommend using a tracked delivery service

9.6 Refund

In case of withdrawal, SIWARA PARIS will refund all amounts paid according to the following terms:

Complete order return:

  • Price of all returned products
  • Initial standard delivery costs (if standard delivery was chosen)
  • If express delivery was chosen: only the standard delivery amount will be refunded

Partial order return:

  • Price of the returned product(s) only
  • Initial delivery costs are not refunded

Special cases:

  • Defective product or error on our part: full refund including all delivery costs + refund of return costs

The refund will be made within a maximum of 14 days from receipt of the returned product or proof of shipment, using the same payment method as that used for the order, unless expressly agreed otherwise by the customer.

ARTICLE 10 – LEGAL WARRANTIES

10.1 Legal warranty of conformity

In accordance with Articles L217-4 et seq. of the French Consumer Code, the customer benefits from the legal warranty of conformity. Products must conform to the description given and have the qualities announced.

The customer has a period of 2 years from delivery of the goods to take action.

In case of lack of conformity, the customer may obtain:

  • Repair or replacement of the product
  • Failing that, a price reduction or contract termination

10.2 Legal warranty against hidden defects

In accordance with Articles 1641 et seq. of the French Civil Code, the customer may also invoke the warranty against hidden defects affecting the purchased product.

The customer has a period of 2 years from discovery of the defect to take action.

10.3 Commercial warranty

Some products may benefit from a manufacturer's commercial warranty. The conditions of this warranty are specified in the documentation provided with the product.

ARTICLE 11 – LIABILITY

11.1 Liability of SIWARA PARIS

In accordance with French and European legislation, SIWARA PARIS cannot under any circumstances limit or exclude its liability for:

- Personal injury caused by our products
- Material damage resulting from a defect in our products
- Damage resulting from a breach of our essential obligations under the sales contract
- Damage caused by intentional fault or gross negligence on our part

11.2 Professional Liability Insurance

SIWARA PARIS has taken out Professional Liability Insurance with AXA France IARD SA (see details in our Legal Notice). This insurance covers our liability within the limits and conditions provided for in our insurance contract.

11.3 Liability for cosmetic products and leather goods

For questions relating to the specific liability of each type of product, please consult Article 4 of these General Terms and Conditions of Sale.

11.4 Force majeure

SIWARA PARIS cannot be held liable for delays or non-performance of its obligations resulting from force majeure as defined by French case law (unforeseeable, irresistible and external events: natural disasters, general strikes, wars, pandemics, etc.).

11.5 Limitation of liability for indirect damages

Within the limits permitted by law, SIWARA PARIS cannot be held liable for indirect damages such as loss of profits, loss of revenue, loss of data or loss of business opportunities, except in cases of serious or intentional fault on our part.

11.6 Use of products

It is the customer's responsibility to:
- Carefully read the composition of cosmetic products before use
- Check for absence of allergy to the listed ingredients
- Use products in accordance with the instructions provided
- Perform a skin tolerance test before first use (patch test)

In case of allergic reaction or adverse effect, immediately stop using the product and consult a healthcare professional. Contact us at contact@siwaraparis.fr to report any incident.

ARTICLE 12 – INTELLECTUAL PROPERTY

All elements of the website (texts, images, logos, videos, etc.) are the exclusive property of SIWARA PARIS or its partners and are protected by intellectual property law.

Any unauthorized reproduction, representation, modification or exploitation is strictly prohibited and constitutes counterfeiting sanctioned by the Intellectual Property Code.

ARTICLE 13 – PERSONAL DATA

Personal data collected during the order is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR).

The customer has a right of access, rectification, erasure, limitation, portability and objection concerning their personal data. These rights may be exercised by contacting contact@siwaraparis.fr.

ARTICLE 14 – MEDIATION AND DISPUTE RESOLUTION

14.1 Consumer mediation

In accordance with the provisions of the French Consumer Code concerning the consumer dispute mediation process, after contacting us and in the absence of a satisfactory response, you have the option of resorting free of charge to a consumer mediation procedure with:

14.2 European online dispute resolution platform

In accordance with EU Regulation No. 524/2013, the European Commission provides an online dispute resolution platform accessible at: https://ec.europa.eu/consumers/odr/

14.3 Applicable law and jurisdiction

These Terms of Sale are governed by French law. In case of dispute and in the absence of amicable resolution, French courts shall have sole jurisdiction.

ARTICLE 16 – ACCEPTANCE OF TERMS OF SALE

Placing an order implies full and unreserved acceptance by the customer of these Terms of Sale.


MANDATORY LEGAL NOTICES

Excerpts from the French Consumer Code:

Article L217-4 of the French Consumer Code:

"The seller delivers goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from packaging, assembly instructions or installation when this has been charged to the seller under the contract or has been carried out under the seller's responsibility."

Article L217-5 of the French Consumer Code:

"The goods conform to the contract:

1° If they are fit for the purpose usually expected of similar goods and, where applicable:

  • if they correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
  • if they have the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or their representative, particularly in advertising or labeling;

2° Or if they have the characteristics mutually agreed upon by the parties or are fit for any special purpose sought by the buyer, brought to the seller's attention and which the seller has accepted."

Article L217-12 of the French Consumer Code:

"Action resulting from lack of conformity is time-barred two years from delivery of the goods."

Article 1641 of the French Civil Code:

"The seller is bound by the warranty on account of hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish that use that the buyer would not have acquired it, or would have given only a lesser price for it, had they known of them."

Article 1648 paragraph 1 of the French Civil Code:

"Action resulting from redhibitory defects must be brought by the purchaser within two years from discovery of the defect."
